Employer Nomination Scheme Visa Application
The Employer Nomination Scheme (ENS) enables Australian employers
to nominate highly skilled overseas workers to fill positions
that cannot be filled from within the Australian labour market
or through the employer's own training programs.
Positions must correspond to an occupation on the ENS List of
Occupations, must pay at least the minimum salary specified for
the occupation in a government Gazette Notice, and must be full-time
and available for a period of at least 3 years. Positions must
also be in accordance with the standards for working conditions
provided for in relevant Australian workplace legislation.
The ENS has two stages:
Stage 1: Nomination by an employer;
Stage 2: Employee’s application for a visa (nominee’s).
Stage 1 - Employer Requirements
The employer needs to show the following:
- Company is located in Australia;
- Company has a position for a highly skilled person;
- The position if full time and for at least 3 years;
- Show Labour Market Testing that indicates they have not been
able to fill the position in the Australian Labour Market (except
MODL positions).
Stage 2 – Employee’s Requirements
The employee needs to show the following:
- Has the required skills for the position;
- Qualified for the position;
- Less than 45 years of age;
- Has vocational English.
