Terms of Service
Australian ETA Visa
WorkOz Ltd (www.workoz.com) provides processing for an Electronic
Travel Authority (ETA), subclass 976, subject to the following
Terms and Conditions.
By lodging an application online with payment through a Work
Oz Ltd visa consultant, engages Work Oz Ltd to provide you with
an Australian visa processing service to which you acknowledge,
confirm an understand, whilst agreeing to the terms and conditions
as set out in this Agreement.
Please be aware that to comply with Department of Immigration
and Citizenship (DIAC) regulations, you are required to read the
document titled “Migration Advice Professional Document”
before viewing your results. A link to this document is provided
in your registration email.
The Client acknowledges that they have had access to and the
opportunity to read this document in full prior to making any
payment to Work Oz Ltd (www.workoz.com).

Definitions
"ETA" - Electronic Travel Authority (ETA), as prescribed
under subclass 976 of the Migration Act 1958. For persons who
require a short stay visit to Australia.
"Business day" - Monday to Friday 9.30am to 5.30am
GMT, excluding all UK public holidays.
"Client" (‘You’ or 'Your') - defined as
a person/persons visiting Work Oz Ltd (www.workoz.com) who has
made payment to Work Oz Ltd (www.workoz.com) for the provision
of an Australian visa or immigration service.
"Client Log-in Area" defined as the secure online system
managed by Work Oz Ltd which allows a client to access our service
from any computer with internet access by way of username and
password.
"DIAC" - defined as the Australian Department of Immigration
and Multicultural and Citizenship.
"MARA" - defined as the Migration Agents Registration
Authority.
"MIA" - defined as the Migration Institute of Australia.
"Registered Migration Agent" – defined as a person
registered by the Migration Agents Registration Authority (MARA).
"Service/Services" - defined as the service which you
request via payment from Work Oz Ltd (www.workoz.com).
"Visa Processing Consultant" – defined as a person
trained by Work Oz Ltd to assist in the processing of temporary
visas for Australia.
"Website" - defined as Work Oz Ltd website, www.workoz.com
"Online Assessment" - defined as Work Oz Ltd online
application which facilitates the user to submit their details
for assessment via www.workoz.com.
Use of Service
The service provided as per the Terms and Conditions, outlined
to include:
Upon Client completion and submission of the online ETA application
form via the Work Oz Ltd website, request for an ETA will be processed
by a Work Oz Ltd visa processing consultant within 2 business
days under normal circumstances.
Your ETA grant is subject to approval from the Australian Government.
If your ETA is approved, we will send confirmation via the contact
details you have provided.
Please note that if you do not respond to any requests we submit
for further details, your ETA application will not be processed
and your payment will not be refunded.
Regardless of whether you decide later that you no longer require
the visa, have a current visa or your visa is not approved the
service charge has been incurred and is not refundable.
Work Oz Ltd cannot accept responsibility if any or part of these
details was entered incorrect.
Please do not arrange any travel to Australia until you have
received email notification that your ETA request has been approved
by the Australian Government.
Fees
The fee for this service is £25 and is non-refundable.
You acknowledge that you are responsible for any other fees that
may be incurred for the requirement of medicals, chest X-rays,
court documents, couriers, certified copies, police checks, passport
renewals and charges relating to the changing of Travel Plans.
ETA Processing times
In most circumstances ETA visas are processed INSTANTLY after
your application is submitted.
However, if any details have been entered incorrectly the application
will be submitted for manual processing. In this instance processing
will take a maximum of 2 business days.
Applications may also be delayed for the following reasons:
- The applicant has criminal convictions
- The application has been "referred"
- Referrals and delays in processing of ETA's
- Some ETA visa applications will be ‘referred’
to the Australian High Commission.
In usual cases, there is an additional 3-4 working day period
of time wait for referred ETA applications. If your ETA visa application
is referred, you may or may not be required to provide additional
personal details to the Department of Immigration.
If the Australian High Commission requires further information
about you, Work Oz Ltd will notify you and advise the Australian
High Commission accordingly and in turn advise you of the outcome.
Referrals and Refusals of ETA's
Work Oz Ltd are only responsible for processing of ETA applications;
we do not and will not offer advice on how to proceed or what
to do in the event your ETA visa application is refused. The fee
paid includes processing of the ETA visa only and does not include
appeals or additional services.
In the event that the request processed on our website establishes
that you have an existing ETA, the fee you have paid is non-refundable.
In such circumstances, we will issue you with confirmation of
your current ETA status and the charge is applied for this service.
If the client enters incorrect information on their ETA application,
the client will be subject to a repeat application and will incur
an additional ETA application service charge of £25.
ETA Conditions
The conditions on a Visitor ETA are:
- It is valid for visits to Australia for tourism or to visit
friends or relatives.
- It is valid for multiple visits within 12 months from date
of issue.
- The maximum length of each visit is three months.
- You may not work while in Australia.
- You must also hold one of the listed ETA - eligible passports.
- The holder must depart within the validity of the Visitor
Visa (ETA).
- While in Australia the holder must not engage, for more than
3 months, in any studies or training.
- ETA visas are electronic therefore no stamp or label will
appear in your passport. The visa is linked to your passport
number.
Regulation Of The Migration Advice Profession
Under Australian law, a person who wishes to operate as a migration
agent in Australia must be registered with the Migration Agents
Registration Authority (MARA).
The MARA maintains and operates a strict Code of Conduct that
is intended to regulate the conduct of migration agents.

Registered Migration Agents who work for Work Oz Ltd are bound
by the code of conduct.

The client acknowledges that they have had access to read this
document prior to making any payment transactions to Work Oz Ltd.
Disclaimer
The client acknowledges that this service is at the clients
own risk.
The service provided is without any warranty, whether expressed
or implied, including without limitation any warranty for the
information, services provided in connection with this service,
including without limitation the processing of Australian Visas
and the outcome obtained by using this service agreement.
The information provided in this site is based on information
supplied by Work Oz Ltd (unless otherwise specified), and is intended
to be up to date and accurate. While every endeavour has been
made to supply accurate information, errors and omissions may
occur. Accordingly, Work Oz Ltd does not accept any liability
for any loss or damage which may directly or indirectly result
from any advice, opinion, information, representation or omission,
whether negligent or otherwise, contained on this site.
Work Oz Ltd, its employees, affiliates, agents, third parties
or related companies will not be liable in any way for any damages
or costs arising from the use of this service or the inability
to gain any access to the service in full or in part.
Work Oz Ltd will not be liable for changes in Australian Immigration
Law that can occur whilst processing of your application that
may result in an non visa grant or visa cancellation.
Personal Profile:
If you use the website, you are responsible for maintaining the
confidentiality of your username and password and for restricting
access to your computer, and you agree to accept responsibility
for all activities that occur under your username and password.
When accessing the log in client Area, you are required to enter
your username and password each time. Since access to this service
is protected by your username and password, it is very important
that you protect your password by making it known only to you.
To ensure you are the only person that knows your personal access
information, all access to your login information should not be
written down or accessible to other persons, even if you believe
it is disguised. Do not disclose your username and password to
anyone.
Work Oz Ltd will not be held responsible for any access gained
by third parties to your username and password, whether the login
details were provided by you or were otherwise obtained.
Work Oz Ltd reserves the right to refuse service, terminate accounts,
remove or edit content, or cancel orders at its sole discretion.
Affiliates, Referrals & Third Party
Work Oz Ltd may receive commissions, referral fees from third
parties where we refer users of www.workoz.com to other websites
that are not under the control of the Work Oz Ltd.
In this case, Work Oz Ltd is not responsible or liable for the
services provided by a third party. We will not be liable for
any content, advertising, products or services on or available
from such websites or material.
Any dealings between you and any third party advertiser or merchant
mentioned or linked to by means of a hypertext link from www.workoz.com
including payment for and delivery of products, services and any
other terms, conditions, warranties or representations associated
with such dealings, are made between you and the relevant advertiser
or merchant. Work Oz Ltd will not be liable for any loss or damage
of any kind incurred as the result of any such dealings.
General
The validity, interpretation and performance of this Agreement
will be governed by the laws of England and Wales.
The Client agrees that the terms and conditions of this Agreement.
No failure or omission by either party to undertake or observe
the terms and condition of this agreement will, except in relation
to obligations to make payments under it:
give rise to any right of action or claim against the defaulting
party, OR
be treated for any purpose as a breach of this Agreement if such
failure or omission arises from any cause reasonably beyond the
control of that party.
Law Governing & Jurisdiction
If any part of these terms and conditions shall be found to
be unlawful it shall not affect the validity or enforceability
of the remainder of the conditions.
Any contracts entered into between you, the user, the client
and Work Oz Ltd shall have been made in England and be governed
by English Law.
